From what we can see, nearly all Operator skins that you have in Modern Warfare 2 will be available in Modern Warfare 3 on day one. The only rule is that you have to have the Operator skin to get it. So if you have not unlocked or purchased a certain Operator skin in Modern Warfare 2, you cannot use it in Modern Warfare 3.

From what we have seen, the process of using your old Modern Warfare 2 skins in Modern Warfare 3 is pretty simple. Activision has stated that all your old Operator skins will be available to use on day one of Modern Warfare 3.
